Terms and Conditions

1. Agreement to Terms

By submitting a reservation, making a payment, or participating in any event offered by Ocean Sailing Adventures ("OSA," "we," "us," or "our"), you ("Participant," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree, you may not book or participate in our events.

2. Events and Services

Ocean Sailing Adventures offers blue-water passage training, ASA certification courses, and related sailing experiences. Event details — including dates, vessel, ports, and itinerary — are provided on our website and in your booking confirmation. All events are subject to change at OSA's discretion due to operational, weather, or safety considerations.

3. Reservations and Payments

A non-refundable deposit (10% of the total event cost) is required to secure your spot. The remaining balance is due according to the payment schedule provided at the time of booking:

• Payment 2 — due 60 days prior to the scheduled departure date.
• Payment 3 — due 20 days prior to the scheduled departure date.

Failure to remit payment by the applicable due date may result in cancellation of your reservation without refund of amounts already paid. All payments are processed securely through Stripe. OSA does not store credit card information.

4. Cancellation and Refunds

Please review our Refund & Cancellation Policy for complete details. In summary:

• Your 10% deposit is non-refundable under all circumstances.
• Once Payment 2 or Payment 3 has been made, those amounts are non-refundable, with one exception: if OSA is able to re-book your spot from the waitlist, a refund of those payments (minus the deposit) may be issued.
• OSA reserves the right to cancel any event due to unforeseen circumstances, including but not limited to severe weather, mechanical failure, or acts of nature. In such cases, a full refund of all amounts paid will be issued. OSA is not responsible for additional expenses incurred by the Participant in preparation for the event (e.g., flights, hotels).

5. Participant Requirements

Participants must:

• Be at least 18 years of age, or be accompanied by a parent or legal guardian who accepts responsibility for the minor and signs all required documentation.
• Be in good physical health and capable of performing the duties of a working crew member, including standing watch, handling lines, and moving about a vessel in open-ocean conditions.
• Disclose any medical conditions, physical limitations, or medications that could affect safety or participation.
• Follow all safety instructions issued by the vessel's captain and crew at all times.
• Execute OSA's Release and Indemnification Agreement prior to departure.

OSA reserves the right to deny boarding or remove any Participant whose conduct or condition poses a risk to the safety of the vessel, crew, or other participants, without refund.

6. Waiver and Release

All Participants are required to sign OSA's Release and Indemnification Agreement (or the ASA Student Waiver for course participants) prior to departure. These documents form part of these Terms and are incorporated herein by reference. Participation constitutes acceptance of all risk associated with offshore sailing.

7. Weather and Safety

Sailing is inherently weather-dependent. OSA will monitor conditions continuously and reserves the right to alter departure dates, routes, or ports of call to ensure the safety of the vessel and crew. No refund will be issued for itinerary changes made for safety reasons. OSA is not responsible for weather-related delays beyond our control.

8. Travel Insurance

We strongly recommend that all Participants purchase comprehensive travel insurance, including coverage for trip cancellation, medical evacuation, and personal injury. Ocean Sailing Adventures is not responsible for losses that may be covered by travel insurance.

9. Photography and Media

Ocean Sailing Adventures may photograph, film, or record events for marketing and promotional purposes. By participating, you grant OSA a perpetual, royalty-free license to use your likeness in such materials. If you wish to opt out, please notify us in writing prior to your departure date.

10. Code of Conduct

Participants are expected to treat all crew members, instructors, and fellow Participants with respect. The consumption of alcohol is permitted at the captain's discretion and is strictly prohibited while on watch. Any Participant engaging in disruptive, dangerous, or unlawful behavior may be disembarked at the nearest port at their own expense, without refund.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Ocean Sailing Adventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in our events. OSA's total liability for any claim arising under these Terms shall not exceed the total amount paid by the Participant for the specific event giving rise to the claim.

12. Intellectual Property

All content on this website — including text, images, logos, and course materials — is the property of Ocean Sailing Adventures and may not be copied, reproduced, or distributed without our prior written consent.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of South Carolina, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration in Myrtle Beach, South Carolina, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

OSA reserves the right to update these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of our services following any change constitutes acceptance of the revised Terms.
